These Terms & Conditions ("Terms") form a binding agreement between you ("you", "the client") and Elmar Clean & Co Corp ("Elmar Clean", "we", "us", "our"), a New York corporation operating the website elmarclean.com and providing cleaning services in Manhattan and Brooklyn, New York. By booking a service, using our website, or otherwise engaging us, you agree to these Terms. Please read them carefully.

1. Services

We provide residential and commercial cleaning and related services, which may include standard recurring cleaning, deep cleaning, move-in / move-out cleaning, Airbnb and short-term-rental turnovers, office cleaning, post-construction cleaning, disinfection and sanitization, and home organization. The specific scope of each booking is based on the property details and the work you request at the time of booking. Tasks not described in your booking are not included unless agreed in writing.

2. Service Area

We operate as a service-area business and serve clients throughout Manhattan and Brooklyn, New York. We do not receive clients at a physical storefront. If your location is outside our service area, we may decline or refer the booking.

3. Booking & Scheduling

Bookings may be placed through our website, our online booking system, by phone, or by email. A booking is confirmed when we provide you with a confirmation of the date and time. To help us deliver the best result, please provide accurate property details, square footage, number of bedrooms and bathrooms, condition, and clear access instructions. Inaccurate or incomplete information may affect pricing, scheduling, or the scope we are able to complete.

4. Arrival Windows

Because of New York City traffic, parking, and building access conditions, appointments are scheduled within an arrival window rather than at an exact minute. We make reasonable efforts to arrive on time and will notify you of significant delays. Any parking, tolls, or building access fees required to service your property may be added to your invoice where applicable.

5. Estimates, Pricing & Payment

Prices quoted before a visit are estimates based on the information you provide. The final price may be adjusted to reflect the actual size, condition, level of clutter, or scope of work, and any add-on services requested. We will communicate material changes where reasonably possible. Payment is due as disclosed at the time of booking. Card payments are processed securely by our third-party payment processor, Stripe; we do not store your full card details. You are responsible for any chargebacks or fees arising from a wrongful payment dispute.

6. Recurring Service Plans

Recurring plans (for example weekly, bi-weekly, or monthly) continue at the agreed frequency until you cancel. Recurring pricing assumes the home is maintained between visits; significantly heavier condition at a visit may be treated and priced as a deep clean. You may pause or cancel a recurring plan by contacting us, subject to the cancellation notice in Section 7.

7. Cancellations, Rescheduling & Lockouts

If you need to cancel or reschedule, please notify us as far in advance as possible. A late-cancellation fee may apply if you cancel or reschedule on short notice, and a lockout fee may apply if our team arrives and cannot access the property within a reasonable time. The applicable notice window and any such fees are disclosed to you at the time of booking. Repeated short-notice cancellations may result in our declining future bookings.

8. Access to the Property

You are responsible for providing safe and timely access to the property, including any building entry, doorman instructions, keys, fobs, lockbox or alarm codes, and elevator or service-entrance arrangements. Any keys or access credentials you provide are handled with care and used only to perform the service. If our team cannot access the property at the scheduled time, the visit may be treated as a cancellation under Section 7.

9. Your Responsibilities

  • Secure cash, jewelry, firearms, fragile heirlooms, and other items of unusual or sentimental value before the visit.
  • Ensure running water, electricity, and heat or air conditioning are available so we can perform the work.
  • Inform us in advance of pets, and secure any pet that may interfere with the work or our team's safety.
  • Disclose any hazards, fragile surfaces, or special-care materials in the home.

10. Items & Conditions We Cannot Service

For the safety of our team and your property, we do not handle certain tasks. These generally include, without limitation: biohazards (including bodily fluids, mold remediation, and pet or pest waste beyond routine cleaning), insect or rodent infestations, hoarding conditions, cleaning that requires climbing above standard step-stool height or reaching exterior/high windows, and lifting heavy furniture or appliances. If conditions on arrival are unsafe or materially different from what was described, we may adjust the scope, reschedule, or decline the service, and a cancellation fee may apply.

11. Satisfaction & Re-Clean Guarantee

Your satisfaction matters to us. If you are not satisfied with an area we cleaned, contact us promptly within the window disclosed at booking, and we will return to re-clean the affected area at no additional charge. This re-clean is our primary remedy for service concerns; we do not provide cash refunds in lieu of a re-clean except at our discretion.

12. Breakage & Damage Claims

Accidents are rare but can happen. Please report any concern about possible damage promptly, within the window disclosed at booking, so we can review it while the facts are fresh. We are not responsible for pre-existing damage, normal wear and tear, items that were already loose, unstable, or improperly mounted, or for damage to items of unusual value that were not disclosed and secured in advance.

13. Insurance & Bonding

Elmar Clean & Co Corp is insured and bonded. We carry general liability insurance and a janitorial bond covering our cleaning operations. A certificate of insurance is available to clients and buildings on request. Coverage does not waive the limitations in these Terms.

14. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to any service is limited to the amount you paid for that specific service. We are not liable for indirect, incidental, special, or consequential damages, or for loss of use, even if advised of the possibility. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Non-Solicitation of Staff

Our team members are valuable to us and to our clients. During your engagement with us and for twelve (12) months afterward, you agree not to directly hire, or engage outside of Elmar Clean, any cleaner or staff member introduced to you through our service, except through us.

16. Gratuity

Tips are never required and never expected, but they are always appreciated by our cleaners and go directly to the team member who served you.

17. Communications & Text Messages

By providing your phone number and email, you consent to receive service-related communications from us — including booking confirmations, scheduling updates, and reminders — by phone call, text message (SMS), and email. Message and data rates may apply. You can reply STOP to opt out of text messages or HELP for help, and you may unsubscribe from marketing emails at any time. Opting out of marketing messages does not stop essential communications about a service you have booked.

18. Photos & Marketing

We may take before-and-after photos of work areas for quality and training purposes. We will not publish identifiable photos of your home for marketing without your consent. Please see our Privacy Policy for how we handle your information.

19. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including severe weather, building or utility outages, transit disruptions, public emergencies, or government restrictions. We will work with you to reschedule affected visits.

20. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in New York. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

21. Changes to These Terms

We may update these Terms from time to time. The current version is always posted on this page with its "Last updated" date. Your continued use of our services after an update constitutes acceptance of the revised Terms.
